Taking South Africa as a casestudy, this book examines how law is being practiced in a postcolonial country with a culturally diverse population. Here state and non-state orderings are increasingly given recognition on a national level by the legislature and judiciary underpinned by a Constitution based on fundamental values and freedoms and global normative standards. The work discusses the influence of globalism on mixed, pluralistic legal orders and presents a conceptualisation and re-evaluation of theories on legal pluralism and mixed legal systems, and the interconnectedness between these two areas of law. The book will be of interest to academics and researchers in the areas of legal theory, comparative law, and legal anthropology.

Christa Rautenbach is professor of law at the faculty of law, North-West University (Potchefstroom Campus), South Africa. She was in the employ of the Department of Justice for 14 years before she became an academic scholar. She is also an advocate of the High Court of South Africa and the treasurer of the Society of Law Teachers of Southern Africa. She has published extensively on subjects dealing with legal pluralism, customary law, mixed jurisdictions, cultural diversity and law of succession in national and international journals, and also presented numerous papers globally.
