This publication creates a clear understanding of the Administrative Adjudication of Road Traffic Offences Act 46 of 1998 (AARTO), and the gazetted regulations. South Africa suffers from an extremely poor track-record with regard to road safety and it has been repeatedly proven that the enforcement of road traffic legislation plays a key role in reducing road carnage.
AARTO aims to change the behaviour of road users to ensure compliance with the road rules and the creation of a safer road environment. The AARTO Act is however better described as being a purpose-built prosecutorial instrument specifically designed for road traffic legislation which largely replaces the Criminal Procedure Act 51 of 1977 (the CPA) in the prosecution of a large proportion of road traffic offences and is premised on administrative law.
The general principles, application, adjudication process of AARTO, and most importantly, the points-demerit are outlined in the publication.
