Nadja Hoffmann erläutert die Methoden zur Koordination des Vertrags- und Deliktsrechts, sowie deren Koordination in grenzüberschreitenden Sachverhalten. Abschließend untersucht sie das Verhältnis des nationalen internationalen Deliktsrechts zum internationalen Einheitsrecht am Beispiel des UN-Kaufrechts. Insgesamt nimmt die Arbeit eine rechtsvergleichende, europäische Perspektive ein.
An EU regulation on private international tort law and a European Civil Code are currently being prepared. Nadja Hoffmann deals with the coordination of contract and tort law in six European legal systems. Any future EU regulation on international tort law will have to be coordinated with the international contract law which has already been unified. The author is favoring party autonomy in choice of laws for torts; in addition, the applicable tort law should be established throughout Europe by means of an 'accessorial connection' to the private international law on contracts. After the applicable law has been determined, an alternative would be to adjust the applicable substantive contract law of one country to the applicable tort law of another country. The author concludes her work by examining how the CISG can be coordinated with private international tort law.
