Klaus Ferdinand Gärditz bestimmt den systematischen Standort des Hochschulorganisationsrechts im Spannungsfeld von Verwaltungsrecht, Wissenschaftsfreiheit und akademischer Selbstverwaltung. Dies irritiert auch die überkommene Verwaltungsrechtsdogmatik, die bislang Fragen der Verwaltungsorganisation eher als instrumentelle Randprobleme behandelt hat. Klaus Ferdinand Gärditz unternimmt im vorliegenden Buch eine Standortbestimmung des Hochschulorganisationsrechts im Spannungsfeld von Allgemeinem Verwaltungsrecht, Wissenschaftsfreiheit und akademischer Selbstverwaltung. Dabei werden auch grundsätzliche Strukturfragen des Verwaltungsorganisationsrechts aufgeworfen und ihre Bezüge zur Reformdiskussion in der Verwaltungsrechtswissenschaft kritisch beleuchtet. German administrative law regarding higher education has been changed profoundly by the university reform. The main topics on the political reform agenda are commodification, hierarchical restructuring, denationalization and administrative professionalization. The foundations of the traditional university organization (based in particular on democracy, equality of the academic staff, and academic self-government) have been deeply shaken as a result of this. In addition, even the general principles of administrative law have proven to be unable to explain these new attempts at administrative reform. In this work, Klaus Ferdinand Gärditz assesses the current situation of university organization in relation to administrative law, academic freedom and academic self-government. In doing so, he deals with the current debate on the administrative law reform and in particular administrative organization.

Born 1975; studied law at the University of Bonn; 2002 doctorate; 2009 habilitation; Professor of Public Law at the Rheinische Friedrich-Wilhelms-Universität Bonn; full member of the North Rhine-Westphalian Academy of Sciences, Humanities and the Arts.
