§ 52a UrhG gestattet es, urheberrechtlich geschützte Werke in elektronischer Form zu Unterricht und Forschung auch ohne Zustimmung der Urheber zugänglich zu machen. Georgios Gounalakis prüft, ob diese urheberrechtliche Schrankenregelung in Art. 14 GG eingreift.
According to Paragraph 52a of the Copyright Act, anyone working in the fields of teaching and research is to be permitted on a small scale to transmit works protected by copyright with the help of electronic data transmission to students or academics to illustrate the subject taught or for academic research without the consent of the copyright holder. This study examines the subject from a constitutional viewpoint, questioning whether this limitation of copyright interferes with Art. 14 of the Basic Law (German constitution) or whether it is covered under public interest.
