Welche Folgen hat die Terrorismusbekämpfung für das Polizei- und Sicherheitsrecht? Wo liegen die Schwierigkeiten bei der Inkorporierung der Europäischen Menschenrechtskonvention? Wie lässt sich die Europäische Union in eine Formenlehre für die Organisation öffentlicher Herrschaft einordnen? Dieser Tagungsband diskutiert drei Themen eines deutsch-französischen Dialogs.
Europeanization and internationalization challenge Germany and France in similar ways. Nevertheless, both legal systems approach these challenges differently due to their different traditions. In this collection of articles, the differing approaches are discussed, focusing on three main subjects. To begin with, the authors deal with the consequences resulting from the fight against terrorism for police and security law. These consequences imply an increasing endurance test for the traditional distinctions in legal forms as well as for the constitutional principles in both countries. Furthermore, they study the incorporation of the European Human Rights Convention into domestic legal systems with their traditionally different conceptions of the role of the judiciary. They then address the theoretical question pertaining to the design of a theory of the federation and to the classification of the European Union as part of a doctrine of legal forms for the organization of public sovereignty.
