Competition law and fair trading laws are facing major changes. In competition law, the European Commission plans to foster actions for damages. National fair trading laws have already been influenced by the implementation of the Directive on Unfair Commercial Practices. Those reforms have their origins in Europe. The present book analyzes the European initiatives and their effects on national laws. The first article deals with the development of European competition law. It is followed by an analysis of the plans of the European Commission and the current state of German and Austrian law with regard to private enforcement. Before dealing with the implementation of the Unfair Commercial Practices Directive, one article focuses on the relationship between competition law and fair trading law. The final study explores whether or not a skimming-off action is a suitable means of private enforcement.
