Work is a right and a duty for everyone, regardless of race, sex, marital status, religion or nationality. It is a moral obligation for all those who are not prevented from doing so by age or medical incapacity. This is the spirit of article 2 of the Labor Code.It follows from the above provision that nationality is not an inescapable limitation on access to work or the right to work in the Democratic Republic of the Congo. Foreigners may work in the Democratic Republic of Congo, subject to certain legislative and regulatory restrictions.The aim of this first edition is to provide the public with general information on the conditions of employment for expatriates in the Democratic Republic of the Congo.

Born in Kinshasa on December 12, 1986, Mr. Katuala TSHIBANGU is legal advisor to the Fédération des Entreprises du Congo and, since July 2020, has been sworn in as Associate Judge of the Kinshasa/Gombe Labor Court. In addition to these two main functions, the author holds a number of other positions.
