Francis McManus provides a critical and comprehensive account of the development of the modern law of negligence, arguably the most important, and indeed, the most litigated area of the law of delict. McManus discusses the leading cases on the subject and reviews the relevant literature.

Whilst the book concentrates on the law of Scotland, McManus also explores how certain areas of the law have developed in Commonwealth countries. Coverage spans the duty of care (including liability for omissions, negligent misstatements, pure economic loss, and psychiatric harm), the breach of the duty of care, factual causation and legal causation.

Francis McManus is Honorary Professor of Law at the University of Stirling and Emeritus Professor of Law at Edinburgh Napier University. He is the author of a number of textbooks including, Delict Essentials 4th edition (EUP, 2021), Scottish Environmental Law Essentials (EUP, 2020), Environmental Law in Scotland (SULI) and Environmental Law in Scotland (EUP,2015). He has also contributed to many other books. He has a special interest in, and has published extensively on noise law. He is the National Treasurer and Scottish Chairman of the United Kingdom Noise Association (UKNA). He is also assistant editor and contributor to Scottish Planning and Environmental Law (SPEL).
