In July 1998, the House of Lords made a landmark ruling (Wells v Wells). Five Law Lords overruled the Court of Appeal and changed the way in which future losses to accident victims should be assessed. This work demonstrates how this decision affects damages calculations.
This new book covers all the law, information and tables on multipliers that PI lawyers need. It contains the full text of the House of Lords' judgment on investment of accident victims' awards. In July 1998, the House of Lords' landmark ruling (Wells v Wells) increased the awards to victims based on the fact that they would be investing their award in less risky investments. This landmark ruling is expected to replace all previous case law. The book includes not only the latest edition of the authoritative Ogden tables but also the much more detailed tables derived from Computing Personal Injury Damages, the acclaimed software package from Butterworths. These new multiplier tables offer a number of improvements: information can be found on a single page without having to cross-refer; they eliminate the horizontal spread of irrelevant discount rates e.g. 1.5 per cent and 5 per cent; and they provide multipliers for every year from 50 to 75, not just for the traditional retirement ages of 60 and 65. The tables also take into account loss of earnings and pensions multipliers for those aged 15 or under at the date of trial.
An introductory essay summarising the new law on multipliers and a guide to how the tables work is included to ensure the reader has the most detailed and up-to-date information on damages calculations.
