I am privileged on behalf of Sidley Austin LLP to have been asked to provide the preface to the 2020 edition of ICLG - Securitisation, one of the most comprehensive comparative guides to the practice of securitisation available today. The publication isin its 13th edition, which is itself a testament to its continued value to practitioners and clients alike.
We are living in challenging times and as I write this preface the structured finance and securitisation markets are dealing with a variety of new issues - from the impact of Brexit and self-determination against the backdrop of new regulations governing the securitisation industry in Europe, to the currently unquantifiable impact of COVID-19 globally. The short and longer term effects on the practice of securitisation of these and other recent developments are currently unclear, but it has been heartening to see how securitisation as a financing technique has continued to withstand the various economic and regulatory developments and how market practitioners continue to pull together to devise sustainable answers to new questions and issues that have arisen. All markets constantly evolve and develop, but it is clear that the financial markets, both
private and public, continue to view securitisation technology as a key tool for the maintenance and development of their businesses.
It seems as critical and relevant a task as ever therefore to maintain an accurate and up-to-date guide regarding the practices and regulation of securitisation in a variety of jurisdictions. The 2020 edition of this publication seeks to accomplish that objective by providing global business leaders, in-house counsel, and international legal practitioners
with ready access to important information regarding the legislative frameworks for securitisation in over 20 individual jurisdictions.
It also surveys practices from the perspective of leading and experienced practitioners in these jurisdictions through the expert chapters and our heartfelt thanks go to all of the many contributors for sharing their knowledge and experience.
