This book offers an introduction to the basic principles of Australian law and its application to the employment relationship at the turn of the new century. For comparative purposes reference is also made to the situation in neighbouring New Zealand. The focus of the book is on the law pertaining to employees. The subject matter reaches beyond "labour law" in the traditional (European) sense, though. Contrary to the legal position in many member states of the European Union, the general, or "common", law continues to play a relatively important role in regulating the individual employment relationship in Australia as well as New Zealand - something which has further increased in significance in recent years as a result of the trend towards deregulation. Therefore the analysis of Australasian labour law must incorporate a discussion of the law of obligations, specifically the law of contract and torts. A particular feature of the book, making it especially valuable for a Belgian/continental European audience, is that Australasian labour law is explained from the perspective of a civilian lawyer.
Even so, ultimately the purpose is not just to analyse the Australian and New Zealand laws from a continental European perspective. An additional aim is to encourage and facilitate a reassessment of the reader's own legal system from a unique angle. The philosophy behind this approach is that the comparative method only becomes a useful working tool when it is directed, not only at informing about foreign law, but also at fostering a critical appreciation of domestic law.
