European private law exists not only as legislation in the form of directives and regulations of the European Union. The judicature and academia make contributions as well. Recently, academia (primarily) presented the Draft Common Frame of Reference, in which the Principles of European Contract Law (Lando Principles) are updated. In the judicature, the European Court of Justice recently caused a sensation in applying the General Rules of Law to private law relationships. These developments are discussed in the contributed articles in this volume. Europäisches Privatrecht entsteht nicht nur im Wege der Rechtsetzung in Form von Richtlinien und Verordnungen der Europäischen Gemeinschaft. Auch Rechtsprechung und Wissenschaft tragen dazu bei. Im Bereich (vor allem) der Wissenschaft ist soeben der Entwurf eines Gemeinsamen Referenzrahmens (Draft Common Frame of Reference) vorgelegt worden, mit dem die Principles of European Contract Law (Lando Principles) fortgeschrieben werden. Im Bereich der Rechtsprechung hat der EuGH in jüngerer Zeit in Aufsehen erregender Weise Allgemeine Rechtsgrundsätze in Privatrechtsverhältnissen angewandt.Die Beiträge des vorliegenden Bandes erörtern diese Entwicklungen.
