Martin J. Adamian redefines the boundaries of privacy law by exposing how centuries of legal doctrine have tethered privacy to property, and calls for a historically grounded, autonomy-driven framework better suited to the digital age.
Martin J. Adamian reimagines privacy, exposing how centuries of legal doctrine have tethered it to property and calling for a more inclusive, autonomy-driven framework fit for the digital age.
Drawing on feminist theory and thinkers such as Hannah Arendt, Jürgen Habermas, and John Stuart Mill, Adamian develops a more relational and dynamic account of privacy—one rooted in autonomy, dignity, and democratic participation. This framework helps unify disparate areas of privacy law, including tort, Substantive Due Process, and Fourth Amendment jurisprudence, by grounding them in shared normative commitments. Through this lens, contemporary issues such as data privacy, reproductive rights, and surveillance are not treated as isolated legal challenges but as central concerns for preserving personal integrity and political freedom. Ultimately, the book calls for a new approach to privacy—one capable of responding to technological change while resisting the commodification of the private sphere.

Martin J. Adamian is Associate Professor at California State University, Los Angeles, USA.
