Autonomie und Normativität sind Schlüsselbegriffe der Gegenwart. Gleichwohl ist deren Bedeutung für die Legitimation moderner Gemeinwesen immer kontrovers geblieben. Der vorliegende Band möchte einen Beitrag zu dieser Debatte liefern, indem er das hegelsche Modell institutionalisierter Freiheit und Autonomie als ein Projekt vorstellt, das auch heute Antworten auf drängende Legitimationsprobleme von Staat und Gesellschaft liefern kann.
Autonomie und Normativität sind Schlüsselbegriffe der Gegenwart. Gleichwohl ist deren Bedeutung für die Legitimation moderner Gemeinwesen immer kontrovers geblieben. Für die Begründung wird entweder auf das individualistische Modell der Aufklärungsphilosophie seit Locke und Kant oder auf den Vorrang der Gemeinschaft im Sinne einer politischen Romantik abgestellt. Hegel hält beide Positionen für defizitär. Er insistiert zwar darauf, dass Personalität Resultat eines Vergemeinschaftungsprozesses ist und steht deshalb in normativer Hinsicht dem Individualismus nahe, ohne aber den Weg eines "romantischen Kommunitarismus" zu gehen. Der vorliegende Band will diese Sichtweise Hegels nicht nur herkömmlichen Hegeldeutungen gegenüber stellen, sondern auch mit heute dominierenden rechtsphilosophischen Positionen konfrontieren. Autonomy and normativity are key concepts of today's world. Nevertheless their significance for the legitimation of modern communities has remained controversial. The substantiation for this is based either on the individualistic model of the philosophy of the Enlightenment or on the priority given to the community in the sense of a political romanticism. Hegel believed both positions to be inadequate. He does insist that the personality is the result of a process of communitization and thus from a normative standpoint is close to individualism, but did not however follow the path of a "romantic communitarianism." In this book, it is the author's intention to contrast this view of Hegel's not only with traditional interpretations of Hegel but also to confront it with the positions in legal philosophy which are dominant today.
