This monograph provides an original piece of critical scholarship which positions ART provision firmly within the context of vulnerability, globalisation and the discourse of injustice and exploitation. It uses the regulation of ARTs in the UK, the US and Italy to explore the diversity and complexities of ART regulation in developed economies in the global north. This provides a lens through which to explore the interaction between restrictive legislation at home, the influx of fertility tourists to the global market and resultant positioning of women in the global north in relation to the global south. The book questions states’ accountability for their domestic regulation, and whether, ethically, such regulation can or should be viewed in isolation or whether it must now be viewed as existing within the global social order. This project seeks to inform debate about the ethics of the global market and its potential regulation with a view to suggesting how such legal regulation might occur.

Dr Rachel Fenton is a Senior Lecturer in Law at Bristol Law School, University of the West of England. Her research interests are in the area of women’s bodies and the law. She has published widely in this and related areas.
